We were honored to represent the family of “Margaret,” a beloved elderly woman whose life was cut short following a fall at her nursing home and repeated failures by her medical providers to recognize and treat her injuries.
Margaret was a kind, gentle woman who was deeply loved by her family. She depended on her nursing home and medical providers to keep her safe. Unfortunately, they failed her.
For years, the nursing home had failed to properly assess Margaret’s risk of falling. She eventually fell while being showered by nursing home staff, suffering serious fractures. Despite her obvious pain and declining condition, the nursing home repeatedly insisted that Margaret was at her “baseline” and failed to send her to the hospital. Her outside medical provider likewise failed to recognize the seriousness of her injuries.
For ten days, Margaret suffered with undiagnosed fractures before her daughter finally insisted that she be taken to an emergency room. By then, the damage had been done. The injuries left Margaret increasingly immobile, triggering a cascade of medical complications. She died approximately three months after her fall.
Margaret’s daughter initially retained another law firm to pursue a wrongful death claim. But after the nursing home offered just $25,000 to resolve the case, she turned to Madia Law.
Our firm spent the next two years aggressively litigating the case against both the nursing home and the outside medical provider. We took approximately 25 depositions, obtained critical admissions from witnesses, and developed extensive evidence of the defendants’ negligence.
Throughout the litigation, the defendants denied responsibility. They maintained that their care was appropriate and argued that Margaret’s advanced age and preexisting medical conditions—not their negligence—caused her death.
The defendants ultimately asked the court to dismiss the case without a trial. We opposed their motions for summary judgment, and the judge denied them in their entirety.

Approximately one month before trial, the nursing home agreed to settle. The outside medical provider continued to deny liability, so we took the case to a jury. After hearing the evidence, the jury found that the medical provider was negligent and that its negligence contributed to Margaret’s injuries and death.
The medical provider settled shortly after the verdict.
Together, the settlements totaled $2.7 million for Margaret’s family.
No amount of money can bring Margaret back or erase the suffering she endured. But we are grateful that her family entrusted us with her story and that we could help them obtain a measure of justice and accountability.
